The Chair of this Commission of Enquiry was Mark Andrew Hawyes

Mr Hawyes was admitted as an Advocate of the High Court of South Africa in 1995. He served as the Chairperson of the National Bar Council of South Africa (NBCSA) from 2012 to 2016. He is a Member of the South African Society for Labour Law (SASLAW).
Mr Hawyes is active in the field of alternative dispute resolution. He has attended to numerous private instructions as Chair of internal disciplinary enquiries, mediations and arbitrations under the auspices of Tokiso.
Mr Hawyes is a part time Senior Commissioner of the CCMA and attends to complex and lengthy arbitrations for this institution from time to time. He is also active in presiding in mediation and arbitration matters at the Education Labour Relations Council, the National Bargaining Council for the Wood and Paper Sector, the Metal and Engineering Industries Bargaining Council, the South African Road Passenger Bargaining Council and the Transnet Bargaining Council.
Mr Hawyes has represented and continues to represent parties as defence counsel in the various Criminal Courts, High Court, Labour Court and Labour Appeal Court.
Mr Hawyes was a member of the National Forum of the Legal Profession for two years (see Section 96 of the Legal Practice Act 28 of 2014) and served on three sub-committees.
Mr Hawyes served various stints as an Acting Judge in the High Courts and Labour Court from 2015 to 2017. A complete record of Mark's judgements can be found at www.saflii.org.
Mr Hawyes was recently nominated for the high-profile role of Public Protector. Corruption Watch had the following comments to make on Mr Hawyes's nomination: Executive summary: Hawyes became an admitted Advocate of the High Court of South Africa in 1995 and has held various leadership positions in the Bar Council. He has a long and distinguished career in labour law, arbitration and mediation. He is currently a mediator and arbitrator for the private company, Tokiso and has recently acted as a judge of the High Court and the Labour Court.
Mr Hawyes is in the process of studying a Masters degree in Tax law to qualify himself to work as a tax practitioner and further develop his skills in the world of commercial alternative dispute resolution.
In relation to this Commission of Enquiry Mr Hawyes has confirmed that he has no connection to any of the parties and as with all his work he will be conducting this Commission objectively and independently without fear or favour.
